The legal framework for your S3SH experience.

1. Agreement to Terms

By downloading, installing, or using the S3SH application ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you must not use the App.

These Terms constitute a legal agreement between you and the developer of S3SH. Your use of the App signifies your acceptance of these Terms.

2. Description of Service

S3SH is a privacy-focused messaging application for iPhone that enables:

Creation and participation in temporary chat sessions without user accounts.
Real-time messaging between multiple participants using session codes.
Optional AI assistant functionality for enhanced conversation capabilities.
Local, on-device storage of all messages and session data.

The Service operates without traditional user accounts, email verification, or cloud storage. All conversations are stored exclusively on your iPhone.

3. Eligibility

You must be at least 13 years of age to use S3SH. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the App.

By using S3SH, you represent and warrant that you meet these eligibility requirements.

4. User Responsibilities

You are responsible for your conduct and any content you create, share, or transmit while using S3SH. You agree to:

Use the Service only for lawful purposes and in accordance with these Terms.
Not use the Service to transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
Not attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service.
Not interfere with or disrupt the Service or servers or networks connected to the Service.
Not use automated systems (bots, scripts) to access or interact with the Service without express written permission.
Secure your device with appropriate passwords, biometric locks, or other security measures to prevent unauthorized access to your conversations.

You acknowledge that S3SH operates on a session-based system without account verification. You are solely responsible for maintaining the confidentiality of session codes you create or receive.

5. Session Codes and Access

When you create a session, you receive a unique session code. Anyone with this code can join your session. You are responsible for:

Sharing session codes only with intended participants.
Understanding that anyone with the code can access that session's conversation.
Managing and deleting sessions when they are no longer needed.

S3SH cannot restrict access to sessions or recover lost session codes. We have no ability to moderate or monitor session content.

6. The AI Assistant ("root")

S3SH includes an optional AI assistant feature that you can enable or disable within any session:

Third-Party Processing: AI interactions are processed by third-party AI service providers. Your prompts are sent to these services to generate responses.
No Storage: AI prompts and responses are not stored on our servers and are not used for model training.
Session-Limited: The AI's context is limited to the current session and does not persist across sessions.
No Guarantees: We make no representations or warranties regarding the accuracy, completeness, reliability, or appropriateness of AI-generated content.
Your Discretion: You should not share sensitive, confidential, or personally identifiable information with the AI assistant.
User Risk: You use the AI feature at your own risk and acknowledge that AI responses may be incorrect, incomplete, or inappropriate.

7. Data and Privacy

Your privacy is fundamental to S3SH's design:

Local Storage Only: All messages, sessions, and user data are stored exclusively on your iPhone using secure SQLite database technology.
No Cloud Storage: S3SH does not upload, sync, or backup your conversations to any cloud service or remote server.
No Data Collection: We do not collect, process, or store your personal information, message content, or usage data.
Your Responsibility: You are responsible for backing up your device if you wish to preserve your conversations. Deleting the App or losing your device will result in permanent loss of all data.

8. Push Notifications

If you enable push notifications, S3SH uses Firebase Cloud Messaging (FCM) to deliver message alerts to your device. This requires generating a device-specific token that is used solely for routing notifications. You can disable notifications at any time through your iPhone's Settings or within the App.

9. Intellectual Property

The S3SH application, including its design, code, features, and branding, is owned by the developer and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

Copy, modify, or create derivative works of the App.
Reverse engineer, decompile, or disassemble the App.
Remove, alter, or obscure any proprietary notices on the App.
Use the App for any commercial purpose without express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement.
Warranties that the Service will be uninterrupted, error-free, or secure.
Warranties regarding the accuracy or reliability of any content, including AI-generated content.

S3SH is developed and maintained by a sole individual without a legal team or extensive resources. While every effort is made to provide a reliable and secure service, no guarantee can be made regarding uptime, data integrity, or freedom from bugs or vulnerabilities.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER OF S3SH SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages.
Loss of profits, revenue, data, or use.
Damage to reputation or loss of business opportunities.
Costs of obtaining substitute services.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if the developer has been advised of the possibility of such damages.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

In no event shall the developer's total liability to you for all damages, losses, and causes of action exceed the amount you paid for the App (which is zero, as S3SH is free).

12. User Content and Conduct

S3SH is designed so that we cannot access, monitor, or moderate the content of your conversations. However, you acknowledge that:

Other participants in your sessions can see your messages.
You are solely responsible for your interactions with other users.
We cannot intervene in disputes between users or remove content from sessions.
We are not responsible for the behavior or content of other users.

If you encounter illegal content or behavior, you should report it to appropriate law enforcement authorities.

13. Third-Party Services

S3SH relies on certain third-party services:

Firebase Cloud Messaging: For push notifications.
AI Service Providers: For processing AI assistant requests.
WebSocket Infrastructure: For real-time messaging connections.

These services operate under their own terms and conditions. We are not responsible for any changes to, interruptions of, or termination of these third-party services.

14. Availability and Updates

We strive to keep S3SH available and functional, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to:

Maintenance or updates.
Technical issues or server problems.
Events beyond our reasonable control.

We may update the App from time to time to add features, fix bugs, or improve performance. You are responsible for keeping the App updated to the latest version.

15. Termination

You can stop using S3SH at any time by:

Deleting individual sessions from within the App (long-press and select delete).
Uninstalling the App from your iPhone.

Uninstalling the App will permanently delete all stored data, including messages, sessions, and settings from your device. This action cannot be undone.

We reserve the right to suspend or terminate access to the Service if we believe you are violating these Terms, though our technical architecture limits our ability to enforce this at an individual level.

16. Indemnification

You agree to indemnify, defend, and hold harmless the developer of S3SH from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your use or misuse of the Service.
Your violation of these Terms.
Your violation of any rights of another party.
Content you create, share, or transmit through the Service.

17. Geographic Restrictions

S3SH is currently available worldwide through the Apple App Store. However, we make no representation that the Service is appropriate or available for use in all locations. You are responsible for compliance with local laws if you access the Service from outside your jurisdiction.

18. Apple App Store Requirements

If you download S3SH from the Apple App Store, you acknowledge and agree that:

These Terms are between you and the developer of S3SH, not Apple Inc.
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for addressing any claims relating to the App.
Apple is a third-party beneficiary of these Terms and has the right to enforce them.

19. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

Update the "Effective Date" at the top of this page.
Post the new Terms on our website and within the App.
Notify you of significant changes through the App or via push notification.

Your continued use of S3SH after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the new Terms, you must stop using the Service.

20. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property disputes.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and S3SH regarding the use of the Service and supersede any prior agreements or understandings.

23. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.

25. Acknowledgment

BY USING S3SH, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
